Acceptable Use Policy.

1. Scope

This Acceptable Use Policy ("AUP") sets out the rules for use of the products and services (the "Service") provided by HKR Media SRL ("HKR", "we", "us"). The AUP applies to Customer and all Authorized Users and governs all use of the Service through any Service Channel.

The AUP forms part of, and is incorporated by reference into, HKR's Terms of Service ("ToS") available at hkr.ai/terms. Breach of this AUP is a breach of the ToS; HKR may suspend or terminate access to the Service in accordance with the ToS, refuse specific requests, remove content, or take any other action permitted under the ToS or by law.

The current version of this AUP is published at hkr.ai/aup and applies in the form posted at the time the Service is used. HKR may update this AUP at any time, with the updated version effective immediately on publication. Customer is responsible for reviewing the current version.

2. General principles

Customer's use of the Service must be:

(a) Lawful — in compliance with all applicable laws and regulations, including those of Romania and Customer's jurisdiction of use;

(b) Honest and in good faith — not deceptive, fraudulent, or designed to mislead;

(c) Respectful of third-party rights — not infringing intellectual property, privacy, publicity, or other rights of third parties; and

(d) Consistent with the spirit of this AUP — the enumerated prohibitions in Sections 3 through 10 are non-exhaustive examples. HKR may refuse work or take enforcement action against use that violates the spirit of this AUP even where not specifically listed.

3. Absolute prohibitions

The following content categories will not be produced under any circumstances. HKR will refuse any such request and may immediately suspend or terminate the Customer Account:

(a) Sexual content of any kind, including without limitation child sexual abuse material ("CSAM"). HKR will report CSAM to the relevant authorities and cooperate fully with law enforcement.

(b) Non-consensual intimate imagery.

(c) Synthetic media of identifiable real persons ("deepfakes") produced without verified prior consent, except as expressly permitted under the exceptions in Section 6.

(d) Content facilitating violence, terrorism, or armed conflict, including incitement, planning, or operational support for such acts.

(e) Content facilitating human trafficking, modern slavery, or exploitation.

(f) Content corresponding to AI practices prohibited by applicable AI regulation, including practices involving subliminal manipulation, social scoring, or biometric mass surveillance.

4. Prohibited uses

Customer shall not use the Service to create or facilitate:

(a) Fraud, phishing, scams, or social engineering;

(b) Identity theft or unauthorized impersonation of real persons or organizations;

(c) Election interference, voter suppression, or political deception campaigns;

(d) Disinformation regarding public health emergencies;

(e) Defamation, harassment, or threats against identifiable persons or groups;

(f) Hate speech or discrimination based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age, or other protected characteristics;

(g) Content designed to exploit, manipulate, or cause harm to vulnerable populations; or

(h) Malicious code, malware, or content facilitating unauthorized access to systems.

5. System abuse

Customer shall not, and shall not permit any Authorized User or third party to:

(a) Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, models, prompts, methodologies, or operational know-how underlying the Service;

(b) Attempt unauthorized access to the Service, the HKR.AI platform, the Customer Account, or any HKR systems; share credentials; or create multiple accounts to evade limits;

(c) Use automated tools, bots, scripts, or scrapers to access the Service or extract Deliverables in bulk, except with HKR's prior written authorization;

(d) Bypass, disable, or interfere with credit consumption mechanics, rate limits, or any other technical controls; or

(e) Use the Service to develop, train, or improve a product or service that competes with HKR's offerings.

6. Restricted categories

The following categories of content are not categorically prohibited but require HKR operator review and approval before production. Submission of a request in these categories is not a guarantee of delivery; HKR may decline at its discretion.

Depictions of identifiable real persons. Depictions of identifiable real persons are prohibited by default. Permitted only under one of the following exceptions, with HKR operator approval:

(i) Satire or parody — with clear satirical or parodic intent, and not deceptive or defamatory;

(ii) Commentary or criticism — with clear commentary purpose;

(iii) Journalism — with journalistic context and factual accuracy; or

(iv) Accurate non-fictional depiction — the person depicted in their public role, at events they actually participated in, expressing views they have actually publicly expressed. Customer must provide verifiable source material (event references, public statements, transcripts, photographs) substantiating the factual basis. Without source material, the work will not be produced.

Every real-person depiction routes to operator review regardless of which exception applies.

Regulated-domain content. Content in regulated domains (including medical, legal, financial, tax, pharmaceutical, and similar) is permitted where Customer provides the regulated text or claims and warrants in writing that the content has obtained the required regulatory clearance, professional sign-off, or compliance review. HKR's contribution is limited to design, layout, and visualization; HKR does not author or modify regulated substantive content.

Children-targeted content. Permitted only with operator review for age-appropriateness. Personal data of children is absolutely prohibited as Customer Inputs under Section 7.

Regulated-industries content (including alcohol, tobacco, gambling, firearms, and cannabis where legal). Permitted with operator review. Customer warrants that it has the legal basis to use, publish, and distribute such content in Customer's jurisdiction of residence and in any other jurisdiction where Deliverables will be sent or published. HKR does not review or verify the legality of regulated-industries content in any market.

Political campaigns, lobbying, or advocacy content. Permitted with operator review. Customer is responsible for any electoral, advertising-authority, or other regulatory disclosures required when publishing such content.

7. Sensitive personal data

Personal data of children is absolutely prohibited as Customer Inputs, regardless of any lawful basis or parental consent.

The following additional categories of personal data are prohibited as Customer Inputs unless Customer has a documented lawful basis under applicable data protection law and HKR's prior written approval:

(a) Special-category personal data (including racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, genetic data, biometric data for the purpose of unique identification, data concerning health, and data concerning sex life or sexual orientation);

(b) Financial data of third parties (account numbers, payment-card details, similar identifiers) without those parties' consent;

(c) Government-issued identification numbers (passport, national identification, social-security equivalent, driver's license) without lawful basis; or

(d) Confidential information of third parties that Customer is not authorized to share.

This Section operates in addition to, and not in lieu of, Customer's warranties on Inputs under Section 15 of the ToS and Customer's obligations under the Data Processing Agreement.

8. IP and ownership

Customer is responsible for the intellectual property cleanliness of all Inputs submitted to HKR and for the downstream use of all Deliverables. Specifically:

(a) Customer Inputs must be owned by Customer or properly licensed for the intended use.

(b) Customer shall not submit Inputs that include copyrighted works, trademarks, brand assets, photographs, illustrations, characters, or other proprietary materials that Customer is not authorized to use.

(c) Customer warrants that downstream use of Deliverables — including any onward distribution, modification, or commercial exploitation — is and will be free from third-party intellectual property infringement.

(d) Customer is responsible for any intellectual property clearances required in the jurisdictions where Deliverables will be used.

Customer's warranties and indemnification obligations regarding Inputs and Deliverables are set out in Sections 15 and 28 of the ToS.

9. AI commitments

HKR's commitments.

(a) HKR will refuse any request falling within Section 3 (Absolute prohibitions).

(b) HKR will not produce synthetic media of identifiable real persons without verified prior consent, subject to the exceptions in Section 6.

(c) For Deliverables that constitute synthetic media subject to AI transparency labeling requirements under applicable law (including the EU AI Act), HKR will apply visible and/or metadata labeling consistent with the applicable regulation.

(d) HKR exercises human supervision over the production of Deliverables, including curation, review, and final quality control.

Customer's responsibility. Customer is responsible for compliance with downstream AI labeling, disclosure, and transparency obligations applicable to Customer as the publisher or downstream user of Deliverables in any market.

10. Sanctions and trade controls

Customer shall not use the Service:

(a) In or for any jurisdiction subject to applicable sanctions or trade restrictions, or by or on behalf of any party subject to such sanctions (including those of the European Union, United States, United Kingdom, or United Nations);

(b) In any manner that violates applicable export-control or dual-use regulations.

Customer is responsible for sanctions screening of Customer's own end-recipients of Deliverables.

11. Reporting and enforcement

Reporting violations. Suspected violations of this AUP may be reported to HKR through the contact channels HKR designates from time to time. HKR will review reported violations promptly.

HKR's response options. HKR's response to an AUP breach (or suspected breach) may include any of the following, as HKR considers appropriate: refusal of specific requests; written warning to Customer; removal of content; suspension of access to the Service; termination of the Customer Account; reporting to relevant authorities; and cooperation with law enforcement. HKR may take any combination of these actions and is not required to escalate progressively.

Refusal notifications. Where HKR refuses a specific request, HKR will notify Customer in writing. The channel of notification is at HKR's discretion (HKR may use the channel previously used for communication with Customer where reasonable). Notifications will use a standardized template referencing this AUP, with optional human elaboration on the specific violation or reason at HKR's discretion.

No prior notice for clear violations. HKR may act without prior notice in cases of clear violation, particularly in respect of Section 3 (Absolute prohibitions).

No formal appeal. This AUP does not provide a formal appeal mechanism. Informal escalation is available for minor violations and for restricted-category determinations under Section 6; absolute prohibitions and resulting enforcement actions are final.

12. Modifications

This AUP applies in the form posted at hkr.ai/aup at the time the Service is used. HKR may update this AUP at any time, and the updated version is effective immediately on publication. Customer is responsible for reviewing the current version.

Each version of this AUP is dated for reference. HKR may, at its discretion, notify registered Customers of substantive additions to the AUP, but no advance notice is required for any change.
